  4. im going to throw a sponge in i never do the online for cars bought in why because i put the onus on the seller with the intrade slip to send it back to dvla for his road tax and now in trade makes them think see why because when everything goes t+ts as it can no matter what the dvla deny you are in the clear because you have your purchase invoice and the wording on it explaining what customer needs to do now with his slip see sometimes going forward isnt always better
  5. make sure on the invoice they sign that it says they have had a test drive as i had a customer the other week return a car because of an uneven tickover speed and he had the cheek to say he wouldnt have bought it if he realised he couldnt get comfortable in it,he had had a 10 mile test drive he would have used it as a wiggle out all this advice comes from lawgistics by the way
  6. my advice think carefully if you go down the see you in court route the fees for £10,000 + claims go stratesferic when the paperwork is submitted by the claimant but it might have changed (.gov is a bit vague) your claimant will claim for loss of use traveling expenses car hire witness costs etc all the court costs and his claim initially will cost 4.5% of the claim so to start at least £450 these can add up to more than the original claim you might think you have a watertight case but you might see the wrong judge on the day who hates the motortrade if you could call in the expert witness of the bmw technician to stand in front of the judge and categorically say no codes you have a fair chance to prove you did everything by the book but you mention he might have missed it ,but it might not be allowed by the court to call him,i was denied my expert witness 3 months into the case or more to the point i never got no reply even though it was handed in at the court office and entered into the original defence the guy has a £10,000 paperweight at the minute and whatever happens he wants someone to pay and he doesnt want it to be him ive said before but will repeat all customers are liers this is the job we are in i would go the route as i said earlier of lobbing his p/x back checking over the bmw for signs of abuse and charging what i also consider is a reasonable sum of £500 wear and tear and all it encompasses remember if it goes to court the car will be laid up somewhere and these customers also try to claim for storage (8 months is normal from start to finish its a lot of money to pay back but if you can afford it get the car back get it fixed and retail it again because trust me here 6-8 months of legal paperwork and the hassles really are not worth it i go to court on principle and ive been advised its wrong to do that and i agree to be honest but im a stubborn old mule
  7. hi have a read here http://www.lawgistics.co.uk/read-news/877 i made a deduction in january for a 7 week car return customer accepted it then he got a call from local citizens advice asking how he got on,he hadnt even told me he had contacted them, he got back in touch by coming to my premises and demanding this deduction back i refused and he told me i was getting an lba,i contacted ca and told them my reduction was in line with usage and i wasnt willing to refund this deduction, they gave me a case number and advised i put in writing to customer my reasons for rejection with a recorded letter advising customer i was willing to go to small claims if necessary, i never heard from him again if it were my car im afraid i would refund /collect /send his clapped out swapper back to him /and make a deduction for fair use thats just me of course,im not a lawyer

People always want to kick you when your up and kick you when your down,i learnt a long time ago to tell other traders business is superb even when it isnt because otherwise they just want to rip into you im sure when the time is right he might start again at least he didnt bubble the company owing lots to everyone which seems the norm these days

Second bite of the cherry usually goes pear for me, but if you definitely think it will retail again then offer 3.5 as suggested by others,explain it will need a full pdi etc again and of course this time it cant be offered as a p/x so its probably going to be sat around for a while so realistically you don't really want it but YOU will leave the bid with her more importantly make sure owner of car fills in a full disclaimer for time owner had it so no come backs on you with regards forthcoming fines and car logged on police computer as a trouble car i assume shes got log book back from dvla

  18. with regards locking wheel nut removal every car is different and creates its own problems each one has to be appraised individually as to how to approach the worst are renault the easiest are ford the spiral sockets with the left hand internal thread you buy are superb for many cars but i cost one socket into each car and see it as a throaway if it pulls me out of the doo

  20. this would come under misrepresentation and i would look carefully at the terms of the selling agent as to whether they have a get out clause,even though its a business to business sale this still comes under the scope of the consumer rights act i would sent an lba to the selling agent with a copy also to the dealer and i would pursue it to the hilt,put the car in a corner and make a stand,

  23. Glad you got a result but what are the long term implications though? I once bought a car from an independent auction, must be 20 years ago now, i prepared it and had it advertised when auction phoned me to tell me they had let it go £400 too cheap ,they admitted it was their mistake but could i please call in with the difference This was the same auction that let me take a paid for car off their premises but a week later they sent the police to my garage as selling dealer couldnt find what had happened to it an an audit made them put it on the at risk on hpi,i wasnt best pleased and had a heck of a job getting an apology off them Guess what............... this auction is no more and it was a very busy place in its time you cant keep screwing people and expect them to keep coming back These places need their butts kicking
