  1. Ring the council and and be very polite tell them the primary use of the property hasn't changed, it is a family home and you have every right to start a small business, in fact the Goverment encourage it. You are not advertising the cars on the street with for sale signs and there isn't any bunting.... Can anyone remember the recent post with the guy and the Councillor, there was also the previous post where BHM showed links to the .gov website encouraging small home business's. ?????
  2. Agreed, but if you go to buy a PC World and by a computer and I’ll develops a problem you have to personally take it back to them, if you go to John Lewis and buy a set of knives and one develops problem it’s your responsibility to return it. The law is slightly different with cars, but what you are saying isn’t unfair trading. The difference is you are adding an “express clause” to the agreement which both parties are contracted to abide. It isn’t unfair.
  3. James, look at it this way...... If the stereo doesn't work, then you can write it on the purchase receipt stating the stereo doesn't work and the customers signs to accept. The CRA states cars must be for purpose, however, if the engine is missing and the invoice states this and the customer agrees then they are buying a car without an engine. If you state on the purchase receipt the car must be returned in the event of a statutory claim the customer has agreed they must abide by the contract. You are not dissolving their rights, you are simply clarifying the terms of the contract. HTH
  4. Mojo, I have no intent on cancelling or changing my package, AT works very well for me, I just don't like the way they operate sometimes and I would love to lose their bill....
  5. FYI Absolute clarity..... http://www.lawgistics.co.uk/read-news/1395#sthash.VgJHOGCL.SU46ZVvU.dpbs Recovery of a vehicle under the Consumer Rights Act 2015 The Consumer Rights Act 2015 states “the trader must bear any reasonable costs of returning them, other than any costs incurred by the consumer in returning the goods in person to the place where the consumer took physical possession of them” therefore, if the vehicle is driveable then you can request that the consumer brings the vehicle back to your premises. But, if the vehicle cannot be driven then “reasonable costs” of recovering the vehicle should be incurred by yourself. This obviously can be costly. If you do not have repair facilities then it may be easier for both parties to have the vehicle diagnosed/repaired at a local VAT registered independent garage near them. However, If your sales invoice states it is the consumers responsibility to return the vehicle to the trader in the event they wish to exercise their statutory rights, this becomes an express clause of the agreement. Lawgistics Members can get advice on all consumer related issues from the legal team, we also sell a full range of stationery to help your business be legally compliant.
  6. I tried the premium package and had the worst month in sales for many years. Complete waste of money. I had words with my rep yesterday after cancelling vehicle check, it’s just another way to interfere / meddle in our business, plus then have the cheek to charge us for it. I’m fed up with being patronised and told how I should run my own business.
  7. What was the straw that made you stop using AT ? Who are you advertising with now ? I would love to lose that AT bill....
  8. Hey Mumsnet, I can teach you how to get 29 days free car hire, it’s easy.. +1 i would tell her point blank she has misinterpreted the CRA and is definitely not entitled to a refund for such a minor wear n tear issue. Tell her, the CRA is designed to protect customer’s and retailers equally, it isn’t one sided. As soon as you say that to a moron billy normally a light switches on in their empty heads... Shes taking the piss and you need to let her know you aren’t a walkover - don’t give her an inch..... Be polite, firm and fair.
  9. No it’s a banger. Sell it as it is.
  10. I’m intrigued... an L reg Focus??? Are you sure ?? What is the manufactured year and model ?
  11. I agree Grant, a 150k 10 year old XC90 is my cup of tea / stock profile. Who takes the above to a stealer for a health check ? Crazy customer with unreasonable expectations...
  12. Like, but test the water with the customer first. Explain to him he needs to be a realist......... Stealers are stealers, old used monster mileage cars are old used monster mileage cars and show all the associated wear n tear. You don't get gold for the price of silver Mr C and you shouldn't expect it.
  13. Thanks Ian, much appreciated I’m well prepared, will be dignified, respectful and put across the facts as per my rights under the CRA. At the end of the day, it’s there equally to protect me equally... Apologies to OP for post hijack.
  14. Simply prompting a possy with a potential bonus.... Think of all those possys you are due but the customer hasn't remembered or been too busy..... nothing wrong with an incentive in my opinion.... At the end of the day it could also prompt the customer to write a shite review......
  15. Welcome James, nice introduction
