Auctions were exempt from CRA but vendors could be liable,but now when they are actively buying in their own stock,I am not so sure.A private punter buying a misdescribed UKCGR at auction which is then found to be unroadworthy will have rights.Basically,auctions should not be allowed to buy in stock,it is a conflict of interest with the other vendors.As for wingeing traders,if they don't have the knowledge and skill to buy at auction,they should not bother!
  2. Yes ! of course,I can see the potential benefits.But it may be difficult to set up as the average motor dealer probably has a different mentality to you.You may be able to get £10- £20 in subs but I doubt you could charge much more.
  3. The theory is good Jim,but there are several automotive Trade associations already.I would say,unless you work 9 til 5,5 days a week (LOL) don't get involved Jim,otherwise you will get sidetracked from running your own business !
  4. You are right,BCA no longer show VAT on buyers fees for margin cars.This is outrageous,1000's of traders will not be accounting for VAT and will be out of pocket! HMRC must have directed BCA on this one,they are the ones who will benefit.How is it,when you have a VAT visit,the inspector never volunteers any mistakes in your favour or things like allowances for business use of your personal mobile phone etc .I have had them try and charge VAT on road tax and on finance balances on negative equity deals.Anyone else had similar experiences.

Telling her from the off to contact warranty company was a mistake.Although she had only had the car for a short time,you appear to have given the impression that she was on her own,it was not your problem.Next time this happens,tell the customer to get the garage to put it back together,then get it collected and either fix it or give a full refund.The fact you reduced the price does not matter.If she takes advice and it goes to a small claims court she can claim far more than the sales price and win.The bottom line is,we are not popular people,when there is a problem,we are always viewed as being in the wrong.In my experience,It is always cheaper to "nip things in the bud".If you have a pitch,these things things happen several times per year !
  6. I recall the first sub prime we did 20 years ago- it was a marathon to get out.Next day the car was back for no reason.Welcome Finance said that is OK,it often happens,just tear up our cheque! After that we never promoted sub prime.Mind back then,only about 10%. of finance proposals were rejected.Now, you have repeat customers who were always good for finance in the past getting rejected because at some stage they have a applied for a Wonga type pay day loan and had their credit rating destroyed.It would help if people understood this !

Top package,7 times cheaper than AT,it is very successfull in US and Canada,if you have a good pitch ,it is worth giving it a go-( we are just in)you can get round the bit about showing time in stock- But remember what the Tesco founder said- "half your advertising works,but you don't know which half"

Been with Natzi West for 25 years- up until the 2008 bail out they were helpful.Since then,I would not borrow £20 from them,the small print would be so ambiguous,you could probably lose your house for repaying it EARLY. Beware of overdrafts they can pull them at any time without a reason! Good Luck

Don't risk going to court,judges don't like car dealers,I have lost better cases than this.I agree with tradex "driven to destruction" etc,but a judge may disagree and it costs you £5000.Get the car back,do the work and liaise with the warranty company,its about damage limitation.We all get at least one of these per year. It is unfair but that is the nature of the business. Forgot to say- £5000 plus you still have to fix it when you get it back. !

You need to show your first years set of accounts if you want to take on some debt.Regarding being on a treadmill,cannot get ahead etc.,get used to it....most of us have been doing that for years.I am not trying to put you off,but if you search free company check for dealers you know and who you think are successfull,check their liabilities and you will get the picture ! Your business model sounds OK to me,see if you can get know a transport manager at one of those large companies and you might get some cheap stock and transform your business.

If you are going to do it,you have to do it right,there are pitfalls.You cannot just give somebody a car and tell them it is on their insurance.We did that years ago and the punter bent the car.It was inspected and found to have a defective h/brake,we were liable.Another fine mess to get out of.You need to have an ins policy allowing you to lend out cars and they have to be right. Then you have to get the punter to sign an appropriate permission form before they go etc
  13. It is worth a go at that price.I know of one dealer who does under £2k stuff,who only uses Gumtree and appears to do OK.( sells plenty but I don't know if they make any money) .Have a look at Car Gurus ,if you have not done so already,we have just signed up ( good price) !

  15. 500 miles in 6 weeks does not sound like it is being used for hire and reward.I would offer her a full refund less a mileage charge of 45p per mile which is the HMRC going rate.As she is self employed and uses the car in connection with her business,I would say she can claim the mileage charge as a tax deductible business expense.

  17. That's right,it's a bit like speedy boarding at EasyJet,you pay extra and then find you are at the end of a long queue of speedy boarders.The EasyJet boss's last job was running AT,maybe she still acts as a consultant for them !
  18. They can probably ban the opening of bonnets by non BCA staff,if the driver refuses to open the bonnet just shout out to the auctioneer when it is in the ring." Can you inform everyone that I have been told this car has a heavy oil leak from the cylinder head. They would have to open the bonnet . Can they not ban private punters,that would be better. Well done those at Bedford !

  20. These guys are judges,I think you can appeal but I was told first you have to get a solicitor to seek permission from a High Court Judge to allow an appeal.Then there is the cost of another hearing .Solicitors alone cost about £200 per hour !
