  1. i class this as a "exaggerated claim " and strongly suggest you bring this to the judges attention. mediation, https://www.smallclaimscourtgenie.co.uk/small-claims-mediation-service/ the above may help, important note, what was discussed here cannot be brought up in court, i.e. the claimant CANNOT say, "well in mediation you offered £x, now your offering nothing.. this "exaggerated claim " [as in costs] could easily bring down the whole case, i would be closely scrutinising every receipt [copy] that is sent to you [as per directed by the courts] in case of fraud. if i am reading this correctly this is your defence, and i would say you don't have to prove it was driven in this condition, only have to make it clear to the judge [dont forget theyre not mechanically minded] for this to happen the vehicle has been driven with no oil, your checks [ oil light] proove this without doubt, put simple, and put clear, 17/18 year old with no mechanical sympathy, ask the claimant directly in court " did you check the oil level and where would you put the oil and what oil did you put in ?" mediation is to save the courts time and money, i would make it clear to her in mediation,this is a exaggerated claim, which will be strongly defended,any paperwork receipts etc will be scrutinised very carefully and a counter claim may be submitted for any incorrect evidence submitted, and i would offer a "token" sum to stop the case, with the condition that ownership of the car is returned to you. hth

  3. best keep putting them fires out then which law ? if you explain clearly and politely that there consumer rights are far better than any warranty, you wont have the hassle of " i thought that would be covered" and the endless headache, don't even consider saying 1 month engine and box, its so open to abuse, do you want to protect yourself or make your car seem more attractive is the question, to protect yourself, then service pdi, mot, to make your car more attractive then have a usp.....

  7. Does a car that's 50% cheaper than new mean its 50% worn out ? no it doesn't, does a car that's 50% of original price mean that some of its components are worn out, no it doesn't ! At 50% of original price the car will have got daily gradual deprecation, this would be acceptable depreciation considered acceptable by a fair thinking person BUT this 50% could be as low as 10% of original selling price, and , if retailing, should still only show gradual daily depreciation , that is why we have such vague laws in retailing used cars, and the last word comes down to a judge what he considers fair wear and tear.

  9. pinto transit on the motorway, inside screen kept freezing, spraying de icer INSIDE to see ahead, then the sleet got on the ht leads, and i spluttered onto hard shoulder, no wd40, so, not wanting to turn it off [ to wipe leads] in case it didn't start again, i sprayed the leads with de icer, the resultant fireball dried the leads, and i continued my journey [note, do NOT spray de icer onto ht ].. the york diesel had a single glow filament in the inlet manifold, idea being that it warmed the air going in, it didnt work ! Them lads in the 3rd lane in there sprinters dont know how lucky they are

  12. re my previous post page 3 ? he has already refused to pay hearing fee of £170 / struck out/ reapplied / struck out... He paid £115 to start the original claim...... If hes not paid the hearing fee then we quite clearly take for granted hes not receiving help with the fees. SO He has increased the size of the claim [ £3700] To start the the claim will now be £205 the hearing fee will be £335 do you really think he will go ahead ? because i do not, and he is telling you this by "text" on a sunday morning ? mans a fool

  14. i constantly [ just like most other traders on here] battle to get over to my customers, that, unlike "people" who "try there luck" at car sales, i , do not. its taken me over a hour today with just one customer to get over to them that i don't " just try my luck" at car sales, sorry but you boil my piss.................. so why anyone's offering advice is beyond me , sorry lads

  16. my heater works in my smoker,but there is a strange smell combination of engine fumes, petrol, and burnt plastic, after 3 mile you get high
