i won too and they appealed and they lost the appeal. blenheim, in a few days [unless youve done this already] you will be exchanging papers that you/they will rely on in court, [do not miss the deadline] these papers will give you a good insight, examine it most carefully [hopefully i advised before on the other thread you asked for "proof" of losses] and pick out points that you can rely on in court for your defence, a simple slip by the other side in there signed for statement of facts [ there story] can crash the case, [ i won by pointing out / proving [amongst other things] the vehicle was driven to destruction, the claimant denied this and i simply asked the judge and the claimant to see paragraph 12 of the witness statement, the claimant denied it but i pointed out there, paragraph 12, you continued your journey] dont forget too, and i hate to say this, if you loose, you ask for the car back in any payout told by the judge, easily forgot! if you win, keep away from claimant after the case in court, listen very carefully to the judge, [addressed sir/madam] only answer questions your asked, do not confuse the judge with jibber jabber [kiss keep it simple] unless it strengthens your side, keep to the facts. oh and write down your key points of defence. dont think because your a motor trader your on the backfoot, that is incorrect advice, you have many years experience, you are skilled at your job, and you know vehicles inside out, the claimant had purchased a vehicle that had all possible checks carried out pre purchase, was helped immediately a problem was forthcoming, and then the "exaggerated claim" as i mentioned on the other thread -

on your paperwork you will be told how long they think the case will last [maybe one hour] the judge normally reads the case before you go in from paperwork submitted, he/she will make notes on this and ask the defendant/claimant more detail on what hes noted. claimant speaks first, to present there case, then its your turn, you must make sure your paperwork is in order, ready to put down the claimant in any defence you have, use a highlighter on the paperwork youve received from the other side pre court day. feel free to cross examine at any time, dont be rude, be smartly dressed but not over the top, look like a worker who knows his job inside out, if the judge interupts you, apologise, and remind the judge that "in your ** years of trading you have never been in this situation before " -

finish . 5 litres £35 delivered you dilute it 50/50 so youve got 10 litres for £35. better than any silicone, doesnt attract dust, wipe on or just spray, i only use this. -

a lot of insurers are wise to the motor trade scam, and many now ask for proof of trading, bills invoices auction receipts sales invoices etc. oh, by the way welcome to the forum being ex police, no doubt you tell every punter as it is a great usp, i often think of doing it myself your comment that trade plates can be stolen should be replaced by trade plates can get lost, some i see on the outside not secured properly, my rear trade plate "holder" was off a plate i found at roadside . best answer is put the plates on the mid, and display them properly, if they cant be displayed correctly take time to think how they CAN be properly displayed. don't hide the original plates [ this the latest from dvla] . i dont beleive trade plates are a grey area at all, only in the eyes of the ill informed -
dont forget to note the the date/time out and date/time back in, so that your not responsible for any speeding/parking etc offences . my local mot station gets this all the time, they test a car, 1 month later customers on phone they've had a "free" health check, and tyres are cracking discs are worn etc, he tells me they use a [the main dealer] traffic light system, green monitor, red change straightaway on there checklists, one customer phoned and said " but my tyres are on amber and i am really worried " bonus systems have a lot to answer for

All parties must file and serve on every other party a copy of all documents which they intend to use at the trial at least 14 days before the final court hearing. so fine tooth comb this and highlight any your not happy with, if you get these documents on the 14th day then "someone" has been in court before, it is so you cant alter yours after reading there's, so send yours on the 14th [recorded] and they cant alter. all the best -

always before, people are impatient, more importantly you can underline your costs in the vehicle and trading standards cant say your offering a full mot when its not mot'd. [ misleading]. eleven months sells just as well because it has not done any more miles. -

blenheim freely admits on page 1 he is willing to reimburse some of the cost, without the full details [claim] none of us can fully answer this case, i, and i would hope that others see this is a exaggerated claim, £9999? surely that is a clue? max allowed claim in small claims is £10000, somebody somewhere has suggested to go for his neck big time, the additional claim of £4800 is ridiculous, and i stick by my earlier post, make the "token" offer in mediation, and if its refused then a full strong meticulous defence is required on every aspect of the claim. -
its the really small spikey hairs i hate no matter how much you hoover you still have to pull them out by hand and you know what the new "dog hair" is dont you? glitter ! wow, that doesn,t come out

i class this as a "exaggerated claim " and strongly suggest you bring this to the judges attention. mediation, https://www.smallclaimscourtgenie.co.uk/small-claims-mediation-service/ the above may help, important note, what was discussed here cannot be brought up in court, i.e. the claimant CANNOT say, "well in mediation you offered £x, now your offering nothing.. this "exaggerated claim " [as in costs] could easily bring down the whole case, i would be closely scrutinising every receipt [copy] that is sent to you [as per directed by the courts] in case of fraud. if i am reading this correctly this is your defence, and i would say you don't have to prove it was driven in this condition, only have to make it clear to the judge [dont forget theyre not mechanically minded] for this to happen the vehicle has been driven with no oil, your checks [ oil light] proove this without doubt, put simple, and put clear, 17/18 year old with no mechanical sympathy, ask the claimant directly in court " did you check the oil level and where would you put the oil and what oil did you put in ?" mediation is to save the courts time and money, i would make it clear to her in mediation,this is a exaggerated claim, which will be strongly defended,any paperwork receipts etc will be scrutinised very carefully and a counter claim may be submitted for any incorrect evidence submitted, and i would offer a "token" sum to stop the case, with the condition that ownership of the car is returned to you. hth
