1 pointThe bottom line is that Judges do not like car dealers.The Judge is unlikely to know that an ABS sensor is not a big deal.I have unsuccessfully defended 3 cases brought by punters in the Small Claims Court where I thought there was no way I would lose.On the other hand I have won cases against an architect,a builder,a clothing wholesaler and the best one BCA.I think you will need to be able to prove that you offered a free repair and that they refused.Also it is important to make sure they have correctly followed procedure prior to issuing their claim.Was it sold with a new MOT,did you get a PDI sheet signed on handover,did you note the mileage when you had it back.How did you word your signed sales invoice . It is very unfair but selling cheapies these days is very risky and you might have to take your medicine on this one if you haven’t got a good defence which the Judge understands.

1 pointSorry guys but if I understand the deal correctly ,I think Mr Brewer’s sales guy deserves a P45 for negligence.Downing a £10k Golf over the phone by accepting payment by Credit Card ? .I think it is OK to accept an initial deposit by Credit Card but even if the punter was on the pitch and clearly legit,I would not accept full payment by Credit Card.It usually means they have no money and there will be faulty merchandise claims ahead and the card company can swipe back the full payment .I don’t think the Police look for stolen cars any more but maybe because Mr Brewer is a popular celebrity and of course the publicity ,they fortunately very promptly went out of their way considering all the other stuff going on at the moment. ….or am I out of touch ?

1 pointHi there,you are right to expect some compensation but I think we need a bit more information. These days it could be a good idea to have a long winded ‘ returns policy ‘ in legalese language. You need to try and create some grounds. I would first confirm to them in writing that you have received their request for a full refund and to Rescind The Contract on the sole grounds that Mrs X does not like the car and that you are taking advice. Did they prepay and why did you offer to deliver it,were there any special reasons.How old are they . Are they still using it and how many miles have they done Was the wife present when you handed it over and does she drive. ( I would be enquiring if she is his wife and lives at the delivery address ) Ask her what car she would prefer. How far are they away from you and was the handover completed ‘ after hours ‘. Is there any prospect of retailing or profiting on the swapper. Might the car need another valet before re offering it and is there any chance you may find one or two new stone chips ( a bit like car hire return guys ). The real reason for the rejection is probably completely different,it’s so annoying.

1 pointI am surprised they lasted so long.How long have Cinch got having lost £300m in the last 2 years ? BCA were making a fortune what with charging huge buyers fees and persuading their main vendors to accept 90% of Cap Clean on forward contracts when most stuff has been doing over 100% of Cap Clean ……so they set up Cinch because they thought Cazoo was doing so well ! You couldn’t make it up.

1 pointI sold a 16 plate grand scenic 1.5 diesel euro 6 80,000 miles and it was near mint for £5,995. The bloke brought it back 4 weeks later parked it as close to the office and hobbled in when we were dealing with a customer threw the door open and said I"m not happy" in front of everyone. I asked him what was wrong and he said his left rear tyre was 19 lbs pressure and he had to pump it up most mornings during the last week and his wiper blades were noisy and were both 27 inch blade type when one should be 24 inch and the other 30 inches. He said he had had to buy new blades himself and the rear blade was 12 inches but should be 13 inches. I told him to go to the local tyre depot and get the tyre checked on my account as he clearly had picked up a slow puncture (it never deflated when it was at the pitch) He then showed a you tube channel on his phone in front of my customer of how to clean out the windscreen drain scuttles saying also the carpet was damp. I booked him in the next day and gave him a loan car and fixed it. 3 weeks later (last tuesday) it was minus 7 degrees and he came in again on saturday and spoke to my salesman in a very aggressive manner saying "I'm not happy" again as it didnt start immediatley on that cold morning he had to crank it 2 or 3 times (probably wants a set of glowplugs but it was fine until then, My salesman said did it start this morning and he said yes no problem and brought the phone out to show another you tube video about glow plugs, my salesman said I"m not a mechanic so the customer said he used to be a diesel mechanic asked me to phone him the next day as a matter of urgency as he was "not happy", I am going to phone him and let him have both barrels about his rude attitude just turning up unannounced moaning about childish things and tell him to bring the car back with all the paperwork as I don"t want him as a customer. Some people are just downright rude and saying I"m not happy will get him nowhere - we sell cars not happiness, if he wants to be happy just fuck off to a comedy night. The chap is a very boring wheezing anorak trainspotting type old fat man on his last legs - hopefully he will have an accident and do the world a favour

1 pointCan't believe today's report in car dealer magazine I was in the pub last night and all the screens had grown men bashing a shuttlecock in what looked like finals Everywhere it said cazoo so they must have been the sponsors. I explained to the wife who they were and what they did and how they wanted to break a working product so got a lot of money off suits who got the money from your investments in isas etc And then today I read this news we've all been waiting for Margaret thatcher will have got it lighter when these boys finally light the touch paper Wouldn't it be nice if in time we had a proper investigation into this business

1 pointIf it wasn’t for the severity of CRA 15 discouraging bona fide dealers from retailing decent cheapies ( and paying VAT on them ) ,there might not be a black market in them.Out of interest,it appears that the ex Lib Dem MP Jo Swinson aswell as being the author of CRA 15 was also a Post Office minister in the Coalition Government allegedly encouraging the fake prosecution of sub postmasters ……..and we are regarded as being dodgy ?

1 pointI told all my customers they were getting 7 days or your money back but didn't use it these last 10 years He is clearly a moaner and I have to say he would have failed my attitude test and the car he wanted always got a major problem seconds before he came for another apraisal just before he said it will be cash you know or we took a deposit on it only 10 minutes ago sir sorry about that, you must have passed him on the way in Life was too short to help the cares in the comnunity If they show signs of pissing you off today then they will definitely be back if you bend and show weekness to them before during or after the sale Some people live to create problem's Currently in the club watching the snooker and enjoying retirement Remember you are the captain and all customers need permission to board your vessel

1 pointNamed drivers don’t appear to qualify for no claims discount when taking out their own policy.We had a similar experience having been individually named for social domestic and pleasure on our fairly expensive company fleet policy which we had with the same insurer for many years.When we retired ,we were taken off our company policy and took out a new private policy with the same insurer.They accepted my application which included full no claims discount so I settled up.Sometime later,I was informed that my no claims discount had been disallowed and that the cover would be cancelled if I did not immediately pay the balance they requested.Although I thought this to be very unfair,I paid the balance ‘ under protest ‘ and complained to The Ombudsman. Sometime later The Ombudsman service got back and they agreed with the insurance company that we did not qualify for any no claims discount and we would have to start afresh having been previously comprehensively covered to drive any car by the same insurer for 40 years without making a single claim.

1 pointTell him in writing you are offering a full refund less rescission of contraft for the useage and any damage, I hope your invoice they signed has the clause "any cost of return in the event of a rejection / refund is borne by the purchaser" They nearly always respond stating that is not they want. They are happy to bleed you dry at no cost to them but the thought they might have to pay for the usage of the car and find another dealer to terrorise involves them phyisically having to do something and lose money is not on their radar. Once you have offered this and told them that you are only prepared to do this you have no liability with them. If they accept it just sell it to a proper customer - rescission of contract due to usage is a grey area it can be as much as a daily car rental Just read your post stating you have already refunded them. Go online to moneyclaimonline and fill it out - it costs £50 which you get back when you win I would put in a claim of £2000 (or 50p / mile usage) so it can be mediated to an acceptable level. https://www.moneyclaim.gov.uk/web/mcol/welcome It's do easy to do and it will put the fear of God on them, they have to respond in 30 days or they lose and you can keep it going ad-infinitum. You will get paid as I always do in such circumstances and they get to experience the shit they gave you !! Be prepared to get bad reviews though, I always try and find out what customers do for a living in case they run a business that I can leave a bad review if needed

1 pointOn the face of it,it appears to be an ‘on premises’ contract but CHR 15 is wide ranging and Small Claims Court Judges ( who are not fans of used car dealers and tend to side with claimants ) may interpret the law in different ways.Who did you invoice,was it the son,his mother or her brother.Would you be able to prove to a judge that the brother ( a close connected party ) inspected the car on your premises and made the contract after contacting his sister.Also did you establish what qualifications the brother had in order to carry out an inspection.For instance anyone trying out a car on my pitch had to give their name and address and provide their usual signature and if they were ‘ in the trade’ to state where they worked. ( I got caught out on that one once )
