  1. You do not have to refund him, you have the opportunity to repair. He cannot refuse the repair.

  3. I don’t get involved in plate changes at all. I simply tell the billy to put it on retention themselves, they can then PX with me and forward the V5. I keep all of their documentation and spare keys until received. Never had a problem.

  5. Get the car back and have it inspected fully. That is your first step. Tell him once, that you will only respond by phone and between the hours if 9-5, you will not respond to texts at all. Take control of the situation. Tell him, once you have had the car inspected you will advice him of the outcome, do not make him any offers or promises until you KNOW what has happened to the car. You are a professional car dealer, act like it.

  7. No I wouldn’t compensate, it’s their plate they pay. They’ve been lazy by not putting the plate on retention prior to selling the car to you.
  8. Yes, they put their plate on retention...they get the certificate, then transfer when the new v5 arrives.

  13. I sold a CLK35O in January to a guy, in March I get a text saying gearbox had a problem and it needs a £980 repair. I said, no problem return it to me (as per our contract) and I’ll get it inspected. It’s passed six months, nothing heard since Well, what’s life without a bit of mitigation.....

  15. You are assuming bending over without knowing the facts. You mean the fault was there at the point of sale and the car was smoking like a trooper and knocking like a pig. However, he didn’t notice that on collection, nor did he for the two months he had it... Nor did he put oil in it.... Who knows.... it’s all speculation..

  19. First point. The PDI shows you are a responsible seller and have done the job right. Second point. Fit for purpose, is irrelevant if it’s down to fair wear n tear. Im getting at clarifying and absolving responsibility when it is and isn’t due.
  20. He’s admitted the fault wasn’t present at the point of sale, something has let go months down the line. It’s Billy’s responsibility to prove the fault was there at the point of sale for a refund. I wouldn’t be bending over at all until I knew the full facts...
