OK...what I would do...email the on line team and ask them to provide details of both your bid and your cancelled bid.If they cannot,ask them to prove that they have not trotted bids beyond the reserve.As I understand BCA rules,this is prevented with proxy bids.They won’t do it of course,I imagine they did run it up.Then if they want to suspend your account,you can threaten to sue them for failing to supply the supporting data and loss of livelihood etc.....We tend to threaten BCA with court action several times per year now to get things done.Our guy just settled up one case and we are about to start another after a new line in their fob offs. With these people you have to fight them.
  2. This is a good one ! I can think of a couple of times I have been standing in the ring,been distracted and have bid and bought the wrong car.I have had to pay up each time.However it appears you may have to prove somehow that you cancelled your bid,I have no idea how.Alternatively,does this Jag fit in with the usual stuff you buy or your general business model.If it sticks out that it is definateley not your stock,take them on.According to their rules you cannot be trotted up beyond the reserve price to your proxybid.The BCA live online team should have a record of who bid against you and a recording of the bids shown on line which I think would turn to green when the reserve has been reached.Ask for as much information as you can before they suspend your account......Good Luck.

That appears to be a stiff sentence when you see what others have recently received at Stoke Crown Court for far more serious offences.Must be the usual car dealer offence sentance premium,it’s a good deterrent.Meanwhile the guy who allegedly according to Vince Cable,was instrumental in destroying,stealing and then profiting from selling off peoples businesses at Nat West was never charged.He is now boss of Santander earning £1.8m !

Hi Lemoj Firstly,you cannot just claim the car back from your customer and refund them,they have good title to it,you may have to pay them consequential damages on top.I would demand that the previous owner gets you a copy of the balance and settlement figure from the finance company,the original finance agreement and the purchase invoice they were given by the supplying dealer showing their signature.If there are discrepancies in the paperwork,that could be good news.If there aren’t,you will just have to settle the balance yourself.In this situation,I have never known a seller settle the balance afterwards.Also bear in mind,that if the agreement is registered with HPI you may have difficulty recovering the balance from the seller if you persue them in the small claims court.Despite What some people might say on here,variations of this happens to all of us at some time.I hope your seller comes with the money,keep us informed...and good luck.

Hi RH Some people might say you have been brainwashed by AT.There are probably people ( competitors) operating exactly the same package as you up and down the UK and paying a lot less.I think that is price discrimination and if you are happy with that,that’s OK.I would suggest that you sell more than your neighbour because you are a better player than him.As for netting £760 per car,I don’t know of anyone who does that,unless of course your mark ups are £3000 per car and you have high prime finance penetration.....Well done to you.As for us,our advertising goes back to the start of AT in about 84.You are right,the magazine was brilliant for us,I may be wrong but I think the most we paid was about £1600+vat per week for 2 full pages in our regional mag.It was a different company then,rates were transparent and they would offer everyone the same discounts like before and over Christmas and also give you credits for printing errors etc.Digital Autotrader will just continue to invent and get away with ways to increase revenue while they are market leaders......
  9. If you want to make a complaint to CMA,they have now said just to download and complete the complaints form and they will establish the classification later.

Limoj is a newbie or amateur and has admitted he has been negligent so he has asked us for help.I am sorry but I don’t think your suggested remedy is the answer as it could create more problems for him.Finance companies often have their own fraud investigation departments so they are used to dealing with this sort of thing.You say he has to refund his customer,surely the customer has good title.Have things changed....

The previous owner does not have to settle it off.Unless things have changed,the onus is with the dealer to settle and then pursue the previous owner.When this happened to me,I persued the previous owner through the court and was awarded £5 per week.However,If the previous owners purchase documentation is flawed,Lemoj might have a chance and the finance company could pursue the supplying dealer for the balance.It could have been a negative equity deal with a warranty,gap and road tax and negative equity loaded onto the selling price.However the VAT sales invoice may not reflect this and the figures may differ from the finance agreement......The previous owner could then claim a void deal because of the flawed paperwork and If successfull,Limoj would be off the hook.

Hi AutoJacob I am struggling to understand.You lie to the finance company and show them a forged receipt.So the finance company goes back to the hirer and who tells them he sold it to the trade who would settle it off.They then establish that you are infact a trader and you have retailed it.Would it not be right to say,you are then in ‘deep shit’.
  13. OK...next,get a copy of the finance agreement and the sales invoice. Why...to check that everything matches,cash price,deposit,chassis number ,p/x allowance,reg no’s ,cost of road tax etc.Sometimes there can be mistakes and you could argue that the finance agreement is void.I have done this before where a previous customer has gone somewhere else and got stitched up and asked for help to unwind the deal.
  14. Sounds promising. However,if you are buying online ( especially Motability ),I can guarantee you will buy stuff where you will find it impossible to get rid of the smell. With BCA it does not form part of the description,so you just have to replace the trim.

I know guys who ‘prep for England’,they routinely take out the seats and carpets and jet wash them.They don’t have much stock,but they charge and get big money for it.I recall when ECU’s were under seats,if you flooded them you had to take them off and leave them to dry on a radiator for at least a week.

I once used a private tennis club car park for a few extra cars.It was secure with CCTV in a good residential area.It was a long time ago and they were delighted to take £200 from me for a 12 month deal.( sports clubs are usually short of money).Today it would probably be a grand but worth it.

It’s no good complaining to AT,the chances are that they will penalise you for doing so.You must complain to the Competition and Markets Authority,they say complaints are confidential.I am in the process of doing this now once I can establish what classification AT comes under.I believe that AT are abusing their dominant market position (over 40%) and are operating an anti-competitive practice with their price discrimination.Should the CMA agree,AT being a PLC with a market value of £3.2bn could be in serious trouble.....So come on guys,the more of us who complain to the CMA ,the better.

  20. We found Cleveland and North Yorkshire stuff to be fairly good but Durham and Northumberland poor to average.We used to get them from all over the U.K. even the RUC ...that’s another story !

How much deposit did you get and how did he pay it,was it debit or credit card or cash.Did he appear sensible .Did he say if he had funds in place or if he was getting his own finance.....Do you do finance...Did you have any contact with him during the 2 weeks..just interested,don’t respond if you don’t want to,no offence intended.
  22. If you want to be successfull at this job,you only need to do half days.The key to this is you must work half days everyday of the week and the other 12 hours are yours !
  23. I think Thames Valley were the first to lease unmarked or civilian spec vehicles and that was long ago.They probably lease a lot more than vehicles now.When you see the state of some forces vehicles at the block,they must struggle to get Wonga to finance them.

Back in the 90s we would give them all a full shoot £125 and plastic w/trims £5 and an MOT with few workshop bills.If you remember ,Police policy then was to service them before they blocked them.I think in the end,we may have forced them to change their disposal policy.....All Our yesterday’s again !
