We have had a fantastic response from the Morortrade both on this Forum and our own Forum about our new mentoring programme! Most dealers looking for assistance just cannot believe that it is available FREE, and that there are dealers out their happy to give up some of their valuable time to help other dealers......well there are! We have recruited 12 mentors in total so far (although if you have relevant experience or feel that you can help dealers with your experience feel free to contact me to be added to the Mentor list) and we have an ever increasing list if those looking for help! Those looking for assistance range from Independents that have been in business for a number if years but are looking to link up with someone similar just so they can pick up the phone to share and discuss issues or just get a second opinion, to some young dealers just at the point of setting up in business or just newly started and find they want a helping hand, and everything in between! So if you are looking for a friendly but experience mentor available just for a general chat or you are desperate for help to start in business or save your current one , feel free to email me jim@jimreidvehiclesales.co.uk and we can add you to the list! We may not have all the answers but I think giving the experience on the list I'm sure we will come close! And it's Free! Jim

Hi WD, james has just pointed me to this. I spent 10 years in the industry advising and working with Finco's, courts etc. I won't go over the number one rule about never buying before you HPI, you know that, but thats always the golden rule.. So, to the issue. Firstly you need to verify that this is a Bill of sale agreement ( the legal term for a log book loan), you are correct that there are differences in how these work, but despite what the BBC have suggested, these are just as likely to be registered with HPI as any other loan. Although the finco has more protection with a bill of sale, recent government review has put them under pressure to work with dealers in situations like this. Sadly, they probably will have title to the car and if it was registered with HPI then we don't have the option to take the route that it wasn't registered. So, its all down to negotiating with the finco. They are only entitled to their original value, so its worth trying to negotiate this down, it may be that they have added fees etc. which you can get taken from the balance to reduce the amount owed. The only glimmer of hope here is that you have been talking to the debtor and you can ask why they have not repossessed the car already if the debt had gone bad, it may be of course that the debtor has moved. They are obliged to go after the debtor for this, but sadly as you now have the vehicle and they know where you are they will take the path of least resistance, you. My advice, store the car somewhere safe while you negotiate, otherwise they could, and probably will, just turn up and take it back... Legally, your customer did not have legal title to the vehicle to sell to you, so you can pursue him for wrongful conversion ( the legal term). However it sounds like he may not be worth very much and you could just be throwing money away. So in summary, Try to get the finco to go after the debtor ( give them his details). Negotiate with them on the value, tell them the car is stored somewhere and you are happy to go to court, this may encourage some negotiation, but if they play hardball you are holding their property, however they will have to provide you with proof of their interest ( which i'd be interested in seeing to see if there is a way out). Lastly, work out if your customer is worth pursuing. if you can get this sorted for £2k, its probably just an expensive lesson, legal fees would be significant in this. Drop me an email, i'm happy to review any documentation you have and give you any help i can Andy

...bit harsh. I may pop in occasionally to see what's app! My missus hasn't got an account at Harrod's. Doesn't mean she can't look in the windows!

Taken from Pistonheads !!!! No wonder we have to put up with idiots after reading stuff like this. Trying to get £1500 or 20% off. It does seem some people seem to think we buy cars for peanuts and put £4000 across them. http://www.pistonheads.com/gassing/topic.asp?h=0&f=23&t=1463425&mid=0&i=0&nmt=Haggling+on+Price&mid=0

Hasn't he sold a car that he knowingly has no right / not got good title to sell? I'm sure somewhere he has committed a criminal act. First thing I would do is call Lawgistic's or take legal advice. If he lives at the address on the invoice at least you can chase him. Obtaining goods by deception maybe??

some fantastic suggestions ! Loving them all Guys ! jim is dreaming with this one ..." Make it law that car dealers have to be nice to each other and that they are at least civil to each other starting with returning phone calls, describing cars correctly and being honest to each other! " Nice thought tho! We definitely need to have a 'licence ' system not only to protect our investment in the motor industry but to protect the consumers from unscrupulous dealers! Why do we have to pay tax on tax ? I guess the list is endless ...

If and when you do get through you can rest assured that many words will be spoken, but nothing will be said. You will be told that the new system is functioning in line with expectations, the massive cost savings (remember?...25p a car) will benefit everyone in the longer term and there will inevitably be a period of time for customers to adjust habits formed over many years. There won't be any apology for the poor communication about the change, or the lack of consultation, nor for the extra workload put upon us for having to train their customers for them. They will not be able to categorically promise that the updates are happening in real time, but their data says they are. There will be no evidence of an increase in cloned cars (ie, same make, model & reg no) seemingly being in different places at the same time and, in essence, the whole thing has been a jolly splendid success.
