Hi Everyone,

Need a quick advice really, I sold a car to a customer about a year ago since she had the car she been complaining about the car misfiring we changed the coil pack, spark plugs, she still come back with same issue we spoke to peugeot specialist and they said whatever they would have done is what we'v done as the car run on chain but not belt so they don't see any issues to come after doing those bits but however we should drain the oil and put the recommended one in which we did we tried the car and it seems fine with no misfiring when we hand over the car back to the customer she calls back complaining about the same issue, to cut it short we sent the car to a peugeot specialist for the second time which they had the car for over 2 months and they can't find any misfiring and customer not happy with that. now he tried mot the car after a year and it come up as failed with some rust underneath the car and she moaning about that which I told her the car come in with the mot...now she saying she will be taking legal action against us which I have no issue with that but she has txt me asking for the full name of owner of the business which I am a sole trader should I provide her with the details or she should correspond through the business can anyone in share some advice on this.

As a sole trader you would be 'Mr Nostops' trading as 'Some Commas Cars' so give her both, it makes no difference, you are liable as a sole trader, there are perks of being a LTD company.

....Pug' with a chain.... I'm gambling (with 100% nowt to go on) it's a Prince engined Pug with a stretched chain causing that misfire...wouldn't cause the rust though...whats rotten on it out of interest.

What name on the sales invoice?

Cheers mate from on the mot there was a number of stuff that failed on but she was questioning me on the following (offside front suspension component mounting prescribed area excessively damaged significantly reducing structural strength floor within 30cm of front sub frame rear mounting point) this what came up on the mot after a year purchasing this.

Deep Breathe , puffed out mate after taking breathe to read that

Chain , guides and tensioner needs changing is my bet , Didn't you see rust on the PDI ? when it was on a ramp ? Being inspected before sale ? 

Rusty car must be a high mile car that was cheap ? 

Needs your details for court action presumably, Wasn't your details on receipt you gave the customer ?

It was the trading name on the invoice.

Its a 2006 307cc sold with 79k on the clock it was in a good nick

I think he meant they came back with issues 2 months in. And then a year on it failed the MOT on corrosion and they're back.

Where in that does it say "corrosion" though? Excessively damaged could be caused if they were treating the car roughly.

Find out the current mileage, make a 45p a mile deduction, offer her a refund less the deduction, get the car back, cube it, stop selling 12 year old pugs.

So it’s been accident damaged, it’s had a wack. Was it there when you sold it and you didn’t know ? Or has it happened since ? The issue here is, if it was there when you sold it then it was sold on a bent ticket, you sold her a dangerous vehicle, I would be very careful.....

AS FAR AS WE AWARE THE CAR WAS STRAIGHT WHEN SOLD IT WASN'T ACCIDENT DAMAGED OR WHAT SO EVER

...such a shame, PSA made some great engines then, but when watered down with German DNA it went so terribly wrong.

so it failed on rust a year after she bought it? is that right

im am only going to say this once so listen carefully 

 

 

 

 

if you do or have done a proper inspection of the car prior to offering it for sale then bodged crash damage repairs will be easily seen (obviously a kick of the tyres and a tick box episode is not good enough it needs to be on a ramp)

the solution is then to make it safe and look presentable

scrap it

or trade it on as spares repairs

i once bought a cat c xr3i declared at an auction the most minted car you would ever find,it was 2 halves welded behind the seats

i reblocked it because if it came apart in an accident then the paper trail would have gone to my door just like this one

 

so a pdi thats had a proper inspection and a proper test drive would have found this crash repair damage and a fresh mot would have brought up high hydrocarbons on the 4 gas tester because its missing at certain revs

 

just sayin..................

Did you have the car MOT'd before you sold it? Because if there is no record of DAMAGE to the suspension area then that is down to her. Clarify if its rust or damage. if its rust which is what you say originally) that isnt unexpected on a 12 year old car.

Misfires vary too. Particularly if the punter is listening out for it. Is it actually a misfire or a bit of a lull on the revs from time to time? if a mechanic cant find it I would suggest the latter. I'm always one who believes that it doesnt matter how old a car is, the punter has bought that one and to them its a 'new car' and that, within reason, you should help where you can. However if they were really looking to take you to court they should have done it months back. How long have they had it back and tolerated the 'misfire' before this bit about the MOT came up?
