    You will always have a keener eye that the standard punter, we had this recently, we had it in stock for months, and the paint job they did on the wings was starting to loose its 'shine', we took it back, and they machine polished it back to life, improved the wings enough to sell them.

    I would write one court friendly email/letter saying that after your failed attempt to recover the car for a refund 2 months ago you are still willing to offer a refund providing the car is returned within 14 days in the same condition it was sold. 

    If the car is not returned within that timeframe you will consider the matter closed.

    If you receive any further correspondence/arguments refer them back to your previous communication.

     

    Sounds logical. Cut down on your time spent being consumed with this idiot.

    how will his actions be looked upon in court? What’s reasonable?

    youve offered him a refund and he’s doing everything in his power to stop you doing exactly that!

    What makes you want to open a garage, do you have an interest in cars or is this purely to make money (something which you seem to do well without dabbling in a completely new sector)

    Got there, stuff was making through the roof and I had a bit of a panic on as my car was a few from the end, didn’t want to public transport it home. 

    Couple of lots before mine was this old Proton thing on a H or J plate, clinging on to a few days MOT. In the hall, ‘who’s got £100? No? £75? £50? Who’ll start me at £25?’ One hand wave later and I’m the proud owner much to everyone’s amusement! Shows how long ago it was, I got it out of the auction, fuelled and home for £100 all in then doubled my money to one of the boys for £200..

    Interesting that in regards to customers claiming for damages, "nor can the consumer recover for loss which they could reasonably have acted to limit or mitigate."

    Going off on a tangent here, but I would personally interpret this as customers not being able to claim for a blown engine had its oil pressure light on for 400 miles, that said, could you prove this, are high-level diag tools clever enough to clock such mileage/date?

    as mentioned, this is rare, dealers that have reputations like you and I are rare, how he can find and harvest a group like ourselves to advertise thousands of decent cars to fall into the hands of realistic customers is the big challenge that I wish him well for

    In your example touch up and leave wheels is what I'd do. If the wheels were slightly worse I would redo them and change colour as David suggested.

    Interesting a couple of you guys have suggested a colour change, if anthracite or black etc isn't the factory colour you could argue that this would put people off?

    or are you suggesting a colour change based on it then standing out from the crowd, one I've always ummed and arrd over and ended up sticking with original.

    Think I'll follow the lead from many of you, and do deposits with card machine and balance on bank transfer.

    CPM, yes he was particular! he rung around and spoke to a local VAG specialist who advised him not to buy my car because there is no evidence of a gearbox oil change which ultimately has cost me a sale, I offered to do the gearbox oil to secure the sale and to put his mind at ease but he couldn't live with the 'what if's' regarding the damage its already done, I think he's looking for a way out and an overdue fluid change was the worst he could find on the 11 year old Audi.
