Consumer Rights says fit for purpose. You must have the opportunity to repair the car before a refund. At least, that's the way i have always known it to be.

We never had the opportunity to repair as he is 6 hours from us he wouldn't bring it back just wanted a refund before we could have a chance to look at the car

    Judge will throw him out.

Been to magistrates court last month infront of a district judge for a council matter.

The judge was very fair to both parties. The landlord took the piss and finally pleaded.

Lot of people are scared of courts and lots of people threaten others by mentioning "take you to court"

Just to add this matter was going to the courts before court date we went to collect the car and refund the money with no luck as garage lost the key. Few days later we recieved letter from courts stating case has been struck out then a couple of weeks later another letter from court stating that the application to reinstate the case has been rejected so no more case. He is threatening a new case now gone up from £2100 to £3700

  3. Going to just ignore him. We also wrote to the court beginning of December explaining we had been to collect the car and key was lost. Garage agreed to deliver the car back to us at their cost and when they arranged delivery and key for the vehicle we told them we will be having it inspected before any money is paid but we was told by the customer we can not start the car never mind inspect it and this has led to a situation where customer won't be getting any money back. What more can we do we ask the courts. Was that a good idea writing to the courts or a bad 1?

  4. Hi, sent letter via recorded delivery to customer asking for return of vehicle and this morning recieved a text from him saying not to contact him again as all letters will not be read and he is changing his phone number and he is putting in a claim for £3700 up from £2100 and extra claim for his witnesses. What is the call of action?

Just noticed on one of my Audis (2006 A4) that the front wings don't perfectly match the rest of the car, I'm guessing they're new because there isn't a spot of rust around the arches at all like you'd expect.

It's only really when you notice it that it looks off by half a shade, do you think any punters are going to be hugely put off by it?

Don't worry it will sell. Most customers are not in the trade and don't have such a keen eye. Honesty is the best way if they ask just tell them it's a 12 year old car previous owner must have looked after it, what more do you expect for the money its not a new car

No there isn’t but there is plenty wrong with trying to negate a punters rights and selling a retail car as SOR is a very obvious way to do that. It doesn’t matter to me you understand, it matters to the authorities.

We just wish people would read the adverts before calling as you have to explain it to them and they be like oh ok i will leave it not want i want. Foookin read advert before getting a boner

You could always fix them and sell them? Controversial I know and call me old fashioned but I consider mechanical recon as part of being a trader!

Yes been down that route but this vw toureg just dont want to fix her up as we know and im sure few others will agree they are nothing but trouble, never bought 1 just came in as a trade in and want rid.

  8. You are right boring dave will all be going auction come new year. Sick of people ringing up who can just about say hello in English trying to ask what is last price when they are always about £1000 under book value except the real cheapies.

  9. We put a honest description of the car sor clearly state on invoice and hope we don't end up with a cock like we dealing with at the moment. Some px cars are perfectly fine to sell at retail price but we just don't take the risk as most tradings are put in to the trade because they have faults.

If it owes you nothing EBay it, brutal ad SOR, with a £100 start and let some tit bid stupid on it.

I agree with the above comments, a shitter SOR'd at £1500 will be interpreted as manipulating SOR Rules if it all goes Pete Tong ;)

To be honest we have had 3 calls on the toureg today and they all from France! Export parts

Everything is negotiable, there must be a smaller independent auction. We would make it presentable and bang it in our local auction (Wilson’s) be sensible with your reserve.

True. Will put it in independent auction come new year full of beginners

Just watch your step when you are advertising stuff SOR and it's priced more than a few hundred quid. Trading Standards may interpret that as you trying to mitigate your risk of a comeback and take a dim view. If you're advertising as SOR, you need a proper sales receipt as suggested above and to cover yourself further, insist the customer trailers it away or, writes a short note and signs it to confirm they know they are buying an unroadworthy vehicle. If you're selling something at £1500 yet it's SOR it doesn't appear to be scrap or SOR only does it? That's a retail car, which you can't sell as an unroadworthy vehicle.

For me, I'm either retailing it (to a sensible customer) or it's scrap and off to the scrapper. There are too many fuckwits out there who see a very cheap vehicle, ignore the VERY harshly worded advert and ring you to ask "is there anything wrong with the car?"

"No sir, it;s mint and it's £1000 behind recommended retail for no reason and you're just very lucky to have seen the advert"

Plenty of morons like that. The cheaper the car the bigger the idiots.

What does it owe you, something like that I'd have thrashed them and nicked it, if I do sell that sort of thing SOR I just stick a ton or 2 on top depending exactly what it is.

Make sure your Invoice clearly states that it is Spares / Repairs, and absolutely nothing is implied or given !!

Owes us nothing, does judder when parked but pulls drive bang on, think its worth £1500. Yes always advertising part exchange stock as spares or repairs or export only and clearly explained and written on invoice.

  14. Yeah will do. Just got a vw toureg 2.5tdi in part ex 2003 rare manual with injector issue but does drive fine. Advertised as spares or repairs or export only. what should we retail it at 145k mot march 2019?

I have to say that if you have never taken a 2 grand hit for whatever reason in 10 years of retailing, you have had a charmed existence.

Yeah was going fine until this prick showed up. From your experience do you think I should refund £2k and tell them to keep the car and get on with it?

  16. We want the car returned within 14 days for a full inspection. There will be no further correspondence or offers made until the inspection has been carried out.

That's it copied and paste from dave2302
