  1. I doubt you are getting the true story. The car could have been purchased for his partner or ex or ‘ bit on the side ‘ and they don’t want it or might even have fallen out.Have you spoken to her to establish who she is.At the point of sale did the buyer state that it would be used far away by a third party covering long distances.I think that is material information a dealer should know when selling an older vehicle.Firstly  and to cover yourself,I would email informing him that as the car has been inspected and having stated as being unroadworthy, the car cannot be used on the public road.If he wishes to process a claim under CRA 15 he or his partner should promptly send a photo showing the current mileage reading together with copies of the said inspection reports and their receipts. He should then arrange to have the car trailered to his home address which he provided at the point of sale. That you will then collect it and your engineer will then promptly carry out a CRA Post 30 Day statutory inspection. If this is not to his satisfaction he should then contact his local Trading Standards Dept. who will then usually contact you with their observations.

if he has been telling you Bullshit,in my experience he won’t cooperate.

    Thanks

I don't watch the telly box but do follow the news so somehow I've missed this

I agree UK plc is firmly down the tubes, I even had to self diagnose to my doctor to get some much needed tablets last month, only thing is I'm now growing boobies as I told him the wrong symptoms

You might have to become part of the LGMGBGT or whatever community .But if you actually saw a GP,you did well.A lot of surgeries now don’t answer the phone but a message says that you are first in the queue and 20 mins later you are still waiting so you hang up which is what they want you to do.Their websites now just say ‘ please don’t bother us if it is not urgent as we are very busy ‘ and if it is urgent dial 101 or whatever. You can’t speak to them about an elderly relative you might be looking after because of  ‘ patient confidentiality’ As for prescriptions,it takes 3 days here to get one and chemist shops now appear to be closing up,I think Boots are closing 200 shops.Everything gets harder,an ex trader friend described how he changed a headlight bulb on his 66 A4,it took him 4 hours and had to put it on a ramp and drop the front bumper .

Just been to the post office to tax a car and asked for some v62, s I got them but was advised they are struggling to get them  from the dvla because taxing at the post office is being stopped in april

I am awaiting a log book via dvla now 6 days overdue which is why I confirm some cars are in trade and then tax them for customers at the post office

What's going to happen come April and how come I found this out via the post office and not mainstream knowledge?

It's bad enough phoning or using webchat to get through to the dvla now as most of them are still working from home

    Comments please,

It might mean that stuff at auction with a ‘ no docs ,get your own ‘ description will be a lot cheaper ! With a finance repo with no docs and still reg’d in the previous owners name,it could take months with DVLA to get a new reg doc !

  4. I wouldn’t risk buying older stuff with no description online. With physical auctions you get a close up feel of a car .In the distant past ( when cars were cheap to fix ),I would often buy non runners but only if the opening bidding was quick which usually meant they had been doctored. It is worth finding a physical auction with good main dealer vendors even if you have to travel long distances.

I just moved into premises. Small site with caravan which i am hoping to convert into my office. But since moving its been very quiet with hardly any queries coming in. I was doing better at home lol. But needed a premises as it wasn't managable doing this from home.

Ive used facebook but not that often now only use Autotrader but might just a list a few on Facebook as like you said its free so theres no harm in listing on there.

Nothing changes. For as long as I can remember, there are usually a few quiet weeks at this time. I was at my old pitch today which sells  plenty and they are also quiet .It’s like the early to mid November window when prices usually drop and you can stock up .Good luck with your new pitch.

  6. It’s me is right provided you don’t buy many.I had quite a few run ins but had quite a big account with BCA so had to tread carefully. The most memorable one which I have mentioned on here before was a mileage problem on a ex Autolease car. Our punter had the car for about 3 months before finding some additional history showing it had done another 30k.So I nipped it in the bud and swapped it for a newer and more expensive car, which I taxed and filled up etc.I initially contacted BCA whose reply was negative as usual so I decided to contact Autolease.I got a prompt but abrupt letter in reply in which they virtually told me to ‘ piss off ‘and not to contact them again. This was ideal so I sued them in the Small Claims Court and welded on various consequential damages claims..On the day,BCA flew their legal guy up to Newcastle on behalf of Autolease. He was a very nice guy and explained they would take it on the chin as they couldn’t upset Lloyds Autolease . He also said that because BCA get so many claims on any given day ,it works better to fob traders off and most go away.I can’t remember how much exactly I was awarded but we were into pocket by several grand .After that any problems we had with BCA were promptly dealt with.

You need to be taking it up with Experian for a start. They should be able to do a mileage investigation. What sort of mileage reduction has it had ? is it just mileage inputted incorrectly at an MOT.

If BCA are saying they warrant the mileage and HPI are saying its clear then your options are pay for the car or lose your account. BCA were always hard to deal with but in the last two years you can get no sensible decision out of them. Its just computer says no.....Pay us.

The sale is void. How long would it take to contact Experian ( the biggest ref agency in the world ) to get sense out of them to confirm their mistake .Even  if they did, it might still bounce back in the future when the car changes hands.Included in the exorbitant buyers fees which they now charge ,buyers are indemnified against this and it was also described as a Premium Select vehicle and an Assured entry which attracts a further fee. You used to be invoiced for the sale price plus an indemnity fee which covered everything.BCA ‘s hard line works because most traders shy away. You have to deep dive into BCA T & C’s and quote both them and those for the National Association of Motor Auctions of which BCA are a prominent member.

Thanks for your reply, BCA told me that the HPI check they did was showing all clear and they emailed me a copy, however, i use Experian and on Experian it shows the discrepancy, will update you when i know more, hopefully on Monday.

Make sure you send them a copy of your Experian report. Its upto BCA to contact Experian to find a remedy .

  9. So basically BCA owned the vehicle as it was entered by their subsidiary We Buy Any Car and both appear to have failed to identify the mileage data discrepancy while carrying out their own due diligence checks.

The data discrepancy may only be an error but it is material to the description and therefore it can no longer be considered a UKCGR premium vehicle.

Under the circumstances,I would request ( by email ) that they rescind the contract but alternatively you might consider accepting the vehicle if the selling price was reduced by £1500 or whatever and the Assured fee cancelled.

You could also enquire from the BCA guy which section of BCA T & C’s you need to refer to with regard to mileage discrepancies effecting Assured entries with BCA owned and entered vehicles and their right to charge storage fees while they are investigating a problem which they themselves have caused and that you require a definitive reply within 48 hours.

I would keep emailing them and always be polite if they call you.

This appears to be straight forward ,there will be various other angles you could follow.

    Please keep us informed.

  10. Whatever you do ,do not settle up.Send your contact at BCA an email saying you are taking advice.I have a lot of experience with this sort of thing but before I can reply could you provide a bit more information.Firstly who was the vendor /seller or what section was it in.When you bid,was it sold ‘ hammer down’ or was it sold ‘ provisional ‘ with your bid accepted later.Did the on line description include service history information.

Because BCA get so many claims ,for years their policy has been to initially fob off or not admit any liability . It works for them because a lot of dealers don’t follow up and just drop their complaints.

  11. While I agree that using privately taxed 4x4 ‘s inside the M25 needs looking at ,this is getting out of hand. What would you do.I doubt The Police will be interested, they just expect you to claim on your insurance.

We don’t yet know why the LR went off the road in Wimbledon, did Vertu sell it to a provisional driver.

Mr Forrester has probably had contact from an intermediary of the local ‘ bad guys ‘ who for a fee will have a quiet word with the ringleaders. They will then ‘shit themselves ‘and have to move away.

    *UPDATE*

Thanks everyone for your great and valuable advice.

Thankfully our customer has been really cooperative and genuinely did not know about the mileage discrepancy.

He contacted the dealership that the car was originally purchased from and they agreed to purchase it off me for the P/X price that was originally given.

We are very lucky to have had this sorted out with both the customer and original dealer being good, honest bloke.

Moral of the story is check MOT history manually as a discrepancy will NOT show on a HPI check.

Good result. The moral of the story is ‘ don’t let anyone stitch you up ‘ especially with other dealers and auctions, never take things on the chin when there is a lot of money involved without ‘ having a go’ .For those who operate larger pitches and employ sales guys ,firefighting stuff like this is a regular occurrence and you get used to it.

Few years ago I sold a 3 years old car that I bought at BCA with warrantied mileage. About 2 years later turned out it had been chipped to adjust the mileage. Unfortunately its not just the issue of sorting the customer out (who in my case couldn't have been any more understanding - and in the end wanted to keep the car)  The bigger worry is that if you end up with a car that you know has been clocked - you'll need to draw the attention of this to any prospective buyer ......which is a bit like saying it was a damaged and repaired....

I'd just try and have a conversation with the bloke you bought it from and try to come to some sort of reasonable agreement, if he won't play ball then I think you are stuck with the problem - I'd then price it accordingly, be 100% up front with enquiries and get rid and move on....  I feel your pain..

Did you not bill BCA or better still, the vendor for your consequential losses.

I hear you, but if he hasn’t checked the MOT history a court would probably say he hasn’t conducted the necessary due diligence?

Nice one but surely the customer would have signed for the mileage on the sale invoice.Do Experian not also confirm the mileage .It’s the customer who should threaten Trading Standards/Court action with his supplier.Unless things have changed,in my experience ,things like this and also with any outstanding finance ,its the first dealer in the line who has the problem. ( if they are still trading ).

  15. You appear to have shown the usual due diligence.I would be informing your customer that under the circumstances, the transaction has to be rescinded plus your costs unless a lower p/x allowance can be agreed for you to accept the vehicle .I would also inform the customer to get in touch with the supplying dealer to see what their reaction is. The buck stops with the supplying dealer and if they are still in business ,I think your customer is entitled to a refund as he has been misrepresented.

  16. It sounds like more FCA bullshit for Consumer Protection for Prime Chucky Duffers who then get proposed to the various sub prime brokers and accepted at enormous % APR.On my old pitch they tell Chucky Duffers to raise their own finance as they only do prime finance.I found years ago that sub prime chucky punters were often trouble ,their swappers were totally neglected and they never returned to buy something else.If you carry good stock, wait for a proper punters to buy it.  Sorry not much help

    Good point Mate.

I think with both Cazoo and Cinch, the latter to a lesser degree it’s about the sizzle and not the steak.

It will baffles me that people were hooked winked into thinking Cazoo was worth 10 times the value of Jardine Motor Group, or Marshall’s for that matter.

They did nothing an ordinary dealer could do 50 years ago, save for buying on line. The exchange program etc is law when it’s a distance sale.

Now they have launched Cazoo wholesale and are established dealers going to deal with them? I think so as they still deal with BCA!

Didn’t know about Cazoo wholesale. It must have cost them a billion to find out that there is more money in charging auction buyers fees than retailing .

What’s going on with the share price down at $1.18 earlier this week and now at $1.54?

I doubt this 40 cent rise signifies any upturn .You have to consider that they were floated at $10 .When they collapsed to $1 ,in order to continue they had to do a ‘reverse consolidation’ or something which meant that for every 20 shares held, they then became 1 share. There might be people out there who still own shares which stand them $200 dollars each.Looking forward to a Netflix documentary about amateur car dealers Cazoo and possibly Cinch ( lost £200m ) and now Car Wow after they have all gone ‘tits up ‘ .Unfortunately when this happens,it could make it more difficult for proper car dealers to get funding……..Rant over !

  19. This sort of thing has occurred for years. Wheel clamping on private land is now illegal.wheel clamping on public land by Police ,Councils and DVLA is allowed.

It is probably a scam or DVLA cock up.I would request more details in writing and a photo.

  21. As the Pet Shop Boys might say. AT net profit Down to £300m on £500m t/o ?  Some people might argue this is theft by overcharging or an abuse of their dominant share of the market. If Banks, Insurance Companies or Utilities or even Tesco or Sports Direct did a quarter of AT ‘s margins they might be hit with a windfall tax.! To get it into perspective Vertu/ Bristol Street Motors needed to do £4b t/o to net £40m and they employ 7000 people……Apologies rant over…..I still live in the days of AT mag…..those were the days !
