Will get on with registering with Lawgistics and have a recorded delivery letter sent out to him explaining we will have the car back and once it has been inspected if no further faults are found and original key you will get a full refund but if issues are found we will be deducting it from the amount and he will need to claim the rest from the garage, give him 14 days to reply if not fooook it lets have a day in court and get it sorted and we will claim for losses.

This is the first time in 10 years we have ever been threatened with legal action as we always deal with any complaints in a professional manner. You seem to have had quite a few issues, so maybe you could fill us in on what we can expect after going to collect the car with no result and now they want to return the car back to us but we can't start or inspect it? We only sell quality used cars which are fully inspected and any faults rectified even new turbos flywheels and clutch kits this way the customer is happy and will pay the full amount without hesitation as the cars are right. Just to add from the moment he broke down we have been in contact with him trying to rectify the problem which caused him to break down but we wont take responsibility for the glow plugs as he was fully aware there was an issue big or small before leaving a deposit

Just to add customer has contacted us last week saying he is cancelling insurance and the tax of the vehicle and if any damage caused to the car its not his responsibility. The car has been dumped outside on the road 100 yards from where the garage is which makes us believe the garage has used it for parts and not kept it on their property instead left up the road. Question is if dvla take the car away and scrap it would we still have to refund if we lost even if the car has been scrapped?

From our experience this will most likely be a costly repair. Just cut your losses and move on to the next one

The help we need is we have been to collect the car and the garage has lost the keys, they agreed to have a new key made and deliver the car back to us at their cost. We told them we will be having the car inspected before any money is refunded and they have told us we cannot start the car or inspect it. Now can you help with this???????

Thanks for your input but i just dont think you have read the post fully to understand the situation we are in and also what has happened. The problem is the return of the car has not gone well, please read the thread and get back with something useful rather then negative input as i thought this was for helping out each other.

It can be started but we not allowed to start or inspect it. It drove 6 hours to get to his house

They apparently have found the original key after 2 months, customer will not allow us to start the car on delivery never mind inspect the car.

That vehicle was sold with no warranty as stated in advert he broke down due to a faulty accelerator pedal which we tried to rectify. Most likely not, but we will take your advice on board, like i sai all part exchange stock is sold as spares or repairs or export only. This way we cant have any issues as we don't allow test drive only allowed to trailer away

In this case the car had 11 months mot and it was priced £1000 under book value with extras including chrome bull bars side steps and even a private number which was worth at least £300

Not really concerned about that any more, main point is now we have been to collect the car with no result as garage lost key they said would have the car returned at their cost but upon arrival we cant start it or get it inspected and we have rejected this as how do we know if there is any key with the car or more issues then stated ie missing parts or unauthorised repairs

Yes but what else can we do? We have been to collect the car with no luck due to lost keys and gearbox fault. We have still said bring the car back and was inspected if al is well you can have the money back. Customer and garage saying we are not allowed to start the car on delivery. What else can we do? Dont want a car back with no engine gearbox or key. Might as well say here is your money just keep the car and send us a packet of cheese and onion walkers

Would the judge not look at the fact we have been to collect the car but due to the garage loosing the keys and telling us it wont drive as gearbox is knackered hence we want a inspection of the car to make sure there is no other faults or missing parts and also if the key is original or a different key with new ecu and locks?
