  1. we had our hour on a  phone, Plaintiff obviously  gave her side to mediator as did i, Important incite  was gained into what Plaintiff  will be basing here case on so valuable from that  point, 

    She made a demand i made an offer, She lowered her demands and i made an increased offer, She lowered it again  but not to an acceptable level, Our hour was up and i am in court early April, Take my  chances and what i have learned might just help me with what the mediator disclosed about the Plaintiff and her case evidence,

    im not being awkward here but please tell me what happened to the three litres of engine oil after customer made to sign sheet saying all good but within 1000 miles its broke due to oil starvation,are you saying she was negligent because although the car uses a litre every 333 miles she should have checked it?

    There was no oil used, It was all still in engine, It was oil Pump that failed and a  loss of  pressure because nothing was being pumped around the engine to cool and lubricate it,There were no leaks  all problems were internally, We tested the  |Oil pressure switch and the wiring to the dashboard  to light up the  Oil light, All this was found to be working, Our view is that  the warning light was ignored and the  damage was caused by a failure to stop after these warning lights came  on

    I am just factoring in my own experience with small claims court judges.Last time I proved the claimant had lied and produced fake invoices but the judge was only interested that the car had broken down.

    this is my issue......................   on paper  it looks BBAAADDDDDDDDD   i agree I believe the  judge will see this only one way regardless of any evidences, My only chance is a  bit of compromise on the  Mediation hearing i have latter today, I do not hold much hope


  3. Exactly. I truly believe i have acted in good faith and done nothing wrong, I have had considerable cost to myself i have made a repair and then suffered costs in finding cause of second issue, Fact remains however ( looking from outside in) it looks like

    rouge garage has sold a un roadworthy car to vulnerable young girl

When we striped it down after the second time it "would not start" we were thinking of our own legal position here so we striped it down and reported our findings to our customer, In that we did not believe we were in any way at fault for her current position and it was negligence that had caused the current problem, Not going to Lie we did not quote her for repair once we had found the problem.

     

    should i not have sold a  car then to someone 17 ??? its a  new one on me, I never gave it a thought, She was with sister and boyfriend at the time who each drove the car for her as experienced drivers  she never drove it and trusted there  judgement

Car was striped by my garage, The cause of the  none starting was identified and thats where our dispute started, There stance is it wont start its my fault and we are saying after striping it down its your fault for  running it with warning lights on and its negligence, Car was put back together and i told her its free to be collected, and thats what she did, 

     

    Collected it and  no further contact was made by her, so much time passed i believed she had accepted what had happened and how it happened and accepted we were not to blame, Car will need  new engine and disks and tyres all around. Car has not moved in 2 yrs

The second time was just 3m into ownership........................  again another "car wont start" issue, this was when they wanted there money  back as they were saying its a repeat of the initial issue.......................... well apart from them both not starting who knows what it is thats wrong..................................they took it to VW MD who did a free visual check obviously inconclusive this was just 20 min of free check, it went to some  breaker friend of there who said it needed a new engine, I asked what he had done to the car to be  confident enough in knowing that and again he had  just "looked at it" and plugged it into a diagnostic system, I asked them to recover it to my garage and thats where we striped it down, Our original timing chain repair was intact and correctly timed, 7 hours of investigation latter we found the oil pump had failed and caused severe damage, So now we knew exactly the root cause of the failure but can not prove it was driven in this contrition, We tested dashboard lights and the oil light is working, we tested the oil pressure switch and again its working, So we believe that there was a flashing light and maybe a chime constantly going off as this car is driven, We believe she drove it 5-10 miles got home with all these lights and chimes going of switched it of and then and only then did it seize up and that`s when she reported next day "it wont start"


  7. She has done less than 1000 miles since purchase and the second terminal issue, I just  feel as reasonable as i am the  judge if it goes there will side with teenage girl, The  burdon of proof is for me to prove, I have no way of proving anything, 

     

    She submitted a 50 page dossier to the court for all proofs of her out of  pocket expenses, This will cost her £350 win or loose she will not even pick up my costs if i were to win, How is that  fair ?? Encourages people with no morals to make fictitious claim against innocent parties

    If she didn’t contact you with further problems, then this is not your fault.

    successful and  permanent fix on original issue within first 30 days, the second issue was 3m later

     

     

    Lawgistics just say it could go either way, No guarantees, My engineers report is conclusive but that is  just going to prove what state the engine is in now, I need to prove she drovie it to get it to that  state that its in now, Not asked her but i guess she will say she didnt  drive it with a warning light on

    what did the car come in for on first major fault

    Would  not start.......................simple as that we striped it down and found the  timing chain had  jumped on the cog, We had got a replacement head  skimmed and new head gasket, Was as good as  new, Got them to sign a second PDI form for that repair to saying they were happy the repair was full repair


  9. I am a Lawgistics memeber and they have been looking after me, However its very much a admin exorcise really i have found rather than a lawyer  to fight for you  service, 

     

    Part i am struggling with is the Proof, I believe i know whats happened and how its  happened but i can not prove she  ran the car after she had the oil pressure warning light on and that is the  reason the engine  is in its current state

     

    I have had an engineer strip it down and found that this is the case, I just  can not prove she drove it in this state though 


  10. she was entitled to a repair and we did this in january 3m after she took delivery at our cost (£750) 

     

    The car has been in storage i have seen it, its not  moved in almost 2 years and has not been further repaired or used in any way, Its currently sorn and on private land

    Guys i have swaloowed that pill on this one...............   your right whatever the rights and wrongs i dont think i can agrue against to much, I am joing to going to have to pay up and reverse the whole thing, 

     

    my question today was about experiences to do with this mediation, anything to look out for anything i should know


  11. I know in my heart of hearts that i have done nothing wrong, But on other hand i can not "PROVE" anything that i need to in order to have a  judge side with me, I am certain it will be a loss,

    The car failed because she carried on driving it with no oil pressure, Warning lights  worked and we striped it and found  oil pump had failed, She had passed her test September the month she purchased it and at 17 yrs old some how  or way  she got the  timing chain  to jump on the cogs and then soon after destroyed the engine with no oil pressure, As mentioned i can say that is what has happened, its how the engine died but what i cant prove is negligence on her behalf, 

    She  disappeared for over 12m i was beginning to think she had accepted my series of events and she had accepted responsibility for her actions in how it became  a broken engine

     

    I am going to mediation, and failing a resolution then going to court, Its a worry and a pressure i just want to have it lifted and not have it hanging over me, 

     

    what would you  sugest is best way for me to do this, I do want a settlement, i will not be  entertaining any of here costs its just purchase price of car i am settling

  12. I wont  bore you with full detail but sold car developed real problem and customer and i are in dispute about how it became in its current position

    2011    11 Polo 1.2  44k   5 services and was sold with full MOT, I sold it Sept 16, 1sts of 2 major problems happened in December and then Jan 17....................over 12m with no contact and then she hits me with 9999 claim on a car she paid £5200, Balance is train, bus, Taxi, Insurance, Loan, Tax, Rail passes, Uber, Parking sensors ect ect to inflate her claim

    Yes i have PDI and all the normal things  we should always do to keep ourselves legal, My issue is that regardless of who is right or wrong and if i am to blame in some way i realise that the  the seriousness of the  issue and the  short time of ownership really does leave me open to judge ruling against me, I am a realist i belive that will be the case 

     

    So i have mediation, I know the format its likely to take the 2 parties talking through intermediary on a phone  but would be interested if anyone has any incite to share, I really could do with settling rather than going to court, I have 1 hour on Wednesday to get the matter resolved, 


  13. are they not leading you if they text and you text and this continues, Its there safe way of protecting them selves from the nasty sales person who wants to sell them something.

     

    Its been mentioned above, Call them and take them through your process, This is our full time profession we do it every single day, How can a Billy who does it once every 3 years be better at it than us
