Hi mate I don’t know what’s going on here. A lot people who can offer advise don’t seem to reply. I’ve had similar issues to yourself in the past unfortunately and will probably have more in the future. you’d rather refund them money and keep some money for the time they’ve used the car i.e mileage used and their name that’s been added onto the log book etc. I do feel for you mate. Some people just take the piss unfortunately. I bet she’s added a few thousand miles to the car, drove it up and down the country and now just wants her money back thinking her dad is going to cover your losses!!!

What do you make of this? My solicitor thinks we can fight in relation to the below: The Vehicle Excise Duty (Immobilisation, Removal and Disposal of Vehicles) Regulations 1997 10.—(1) Subject to the provisions of this regulation, the custodian of a vehicle delivered to him in accordance with regulation 9(3) may dispose of it by selling it or dealing with it as scrap, as he thinks fit. Where the owner of a vehicle has disclaimed all rights of ownership of a vehicle, it may be disposed of pursuant to this regulation al any time. In a case not falling within paragraph (2), a vehicle shall not be disposed of pursuant to this regulation before the end of the period of five weeks beginning with the date on which the vehicle was removed in accordance with regulation 9(3) and until the custodian has, for the purpose of ascertaining the owner of the vehicle, taken such of the steps specified in Schedule 2 to these Regulations as are applicable to the vehicle and either— he has failed to ascertain the name and address of the owner, or the owner has failed to comply with a notice in accordance with paragraph (4) served on him by post. (4) A notice under paragraph (3)(b) shall be a notice addressed to the owner which— (a) states— (i) the registration mark and make of the vehicle; ii) the place where the vehicle was found before it was immobilised; (iii) the place to which the vehicle has been removed; (iv) the steps to be taken to obtain possession of the vehicle in accordance with regulation 12; (v) that unless the vehicle is removed by the owner on or before the date specified under sub-paragraph (b), the custodian intends to dispose of it; and (b) requires the owner to remove the vehicle from the custody of the custodian within 21 days of the date on which the notice was served. (5) Where it appears to a custodian of a vehicle that more than one person is the owner, such one of them as he thinks fit shall be treated as the owner for the purposes of this regulation. It’s only been 3 weeks for me and they’ve sold it and told me to do one.

Hi i am in the process of speaking to one now. Thank you so much for your reply mate. I honestly really really appreciate it. I’ve been upset all day and did not sleep a wink last night. I feel like I’ve robbed by some ‘legitimate gangsters’ and there is nothing I can do. I even went to the compound today and saw my vehicle parked there. I tried speaking to the lady at the reception and she was completely rude and arrogant. basically telling me to email dvla customer relations and wait for them to get back to me. The get back to you the following day sending you an automated email telling you your vehicle had been sold and there is nothing you can do at all. This was a a crazy situation to be in especially when you have a family member who is severely ill in hospital too. I don’t wish this on anyone even my enemies.

I can prove it all but not getting anywhere with them. The car was taken to the garage on the 11th and was impounded on the 11th too. The car when I bought it from auction was in trade and has been since. They say they contacted the previous keeper and did not contact me at all. When you buy a car from the auction do you put it onto your trade name or do you leave as is as it’s currently in trade? They didn’t even leave any notices or anything and just simply took my car and did not contact me and told me my car had been sold on Tuesday at Wilson’s auction. spoke to Wilson’s auction and they have said that the only way they would stop the sale is if dvla contact them and tell them but dvla are not doing this. The compound are complete idiots too. NSL compound in Leigh absolute scum bags!!

Hi yes it was left on the road for the mechanic to mot it and fix the gearbox issue for me. The garage was closed so he would’ve sorted it the following day. The dvla then impounded it and took it away. dvla knew it was in trade and was insured on my policy but didn’t contact me once to tell me they had my car. I have just been told that they sold it at Wilson’s auction on Tuesday and it’s still parked on their compound when I saw it yesterday. I do not know what to do at all. I’ve just lost a load of money on a car and feel like I’ve been robbed by professional thief’s It was impounded because it was not taxed but I didn’t get any contact from them telling me they had my vehicle at all

Hi guys advice needed please. Got a car which has a gearbox issue and isn’t driving and is currently in trade at the moment. got it taken to a garage to get the car fixed and mot’d on the 12/7/24 so that I could tax it. The was parked on the road and was left there by a recovery driver for the mechanic to pick up and take into his garage. on the very same day the car had been imported by the dvla to their compound. unfortunately on the very same day my father had been taken to the hospital and has been severely ill ever since so my head has been all over the place. The dvla knew the car was in trade but never once contacted me and had in-fact contacted the previous keeper so they say. I have had a family member who is severely poorly in hospital so not checked up on my car until yesterday only to realise it wasn’t there. Spoke to the police who said it was importered in July. I have not received one letter telling me it had been imported even though I am registered as a trader with the dvla. phoned the compound and the operator who is very rude has said it’s too late the vehicle is being sold at auction and you ain’t getting it back even after I have explained my situation to her. She then gave me an email address and told me to email customer relations. I can do anything until I hear back from customer relations. basically they will probably tell me that my £10000 car has been sold and there is nothing I can do or they will tell me to pay nearly £2000 to get may car back even thought they didn’t tell me it had been compounded. The car was on my insurance so surely they could’ve contacted me and told me sooner. I really do not know what to do and feel like some gangsters have just robbed me of £10000 and there is nothing I can do. any help or advice will be greatly appreciated.

I don’t think it’s the salespersons fault. Unfortunately some people are just idiots and I’ve had my share over the last few years years too. They annoy the living day lights out of me. The good ones make make it worth it though!!

Hi guys hope you’ve all had a good Christmas and all the best for the new year. regarding the above topic I did pick the car up and refunded the silly customer all his money. I was sick to death of him and his mrs sending emails and messages everyday threatening about court!! However when the car was picked up I noticed his fat mrs had added 3500 miles on the clock and had in fact been driving it even when they were complaining to me telling the car wasn’t fit for purpose and that I had put their kids in danger!! I am now wanting to these idiots to court as I am going to be out of pocket by £1000 at least. I have proof of all the messages and when they started complaint to me about this car originally so she should’ve never have added 3500 miles on the clock. what do you guys think? I know I probably sound petty but everyone’s struggling these days and I can’t stand people who have the nerve and the cheek to treat people who are trying to earn a simple living this!!!

Mate I know but I can’t risk him taking us to trading standards. I swear we haven’t done anything wrong at all and can prove this but they’ll definitely find something on a 13 year old car. I hate people who take advantage of people who genuinely trying to earn a living and not cheating the system!!

I know mate it’s a nightmare. I can’t believe traders don’t have a leg to stand on though. Customers threaten with trading standards and we have to get our cars back on their say so. It’s ridiculous.

Hi both thank you for replying and apologies about the late reply. I very much doubt I am getting the true story as well. I did speak to Kwik fit today who checked over the car and they said the rear callipers,discs,pads and an actuator sensor need changing on the car but the warranty will not cover this. The car was sold in July but was mot’d in April on around 76,000 miles and when it was sold it was around the same miles too. It’s the customers partner and they’re both horrible. honestly I absolutely had customers like these two idiots. when they bought the car they did say they were going to drive it back and forth to Cardiff. I have asked him over and over again for the mileage details and the details surrounding the car being ‘unroadworthy’ and he is not having and just wants a full refund and expects us to pick the car up too. I can’t believe tarders don’t have a leg to stand on when coming across these idiot customers. the guy has basically had the car for 2 /12 - 3 months and now just wants a refund. his mrs the idiot also said we advertised the car with Bluetooth but never did and we proved this to her. I swear I’m well angry and would loose my temper if he was anywhere near me!!

He’s in Stockport his Mrs is in Cardiff and she’s got the car with her in Cardiff. Cardiff amid about 3-4 hours away from us and Stockport is around the corner. The customer is a complete and utter pain.

We sold a customer a car back in July this year. The car is 13 years old and we sold it with a 12 months mot. we changed the coil springs and a suspension part on the car when selling it and the car passed its MOT as well. The mechanic said that the breaks were fine and that they could be changed on the next mot which is due in April 2024. the customer started complaining because the engine light that came on in September and after he got a proper diagnosis done on the car the turbo sensor needs changing on the car. we have given him a 6 months warranty which will cover the sensor but he is being a complete and utter idiot. He’s also been told that the break discs and pads need changing and somehow the car is not in a roadworthy condition anymore but won’t send us the proof stating this. He wants us to pay for the dics and pads on the car which is barbaric. He is threatening us with trading standards and wants a full refund because of the above. what can we do? Do we have a leg to stand on? The mot was done properly and we never cut corners. he’s saying he will only send the report to us via trading standards and that he has had the car checked over by a green flag engineer too. any advice will be much appreciated.

Hi all What on earth is going on? Bought like 7 cars in the last couple of weeks and they’re all knackered from diff replacements, transfer box replacements, new head gaskets, gear boxes, timing chains and much more!! Don’t even know where to go to for stock anymore. Is this what it’s going to be like for every now? How are you guys finding your stock?

Hi hope you’re all doing well. Can anyone recommend a decent diagnostic tool for German cars. I had an issue with an car once as adblue fault made car completely stop. The mechanic used a tool which gave me an extra few miles on the car to get me home and then car went dead again. Anyone know what tool this was? and what is a decent diagnostic tool to get for German cars? Thanks in advance!!

I basically wasn’t able to pay for the vehicle due to two deaths in the family so therefore business was closed and didn’t shift any stock. There’s 3 other vehicles which they’ve taken back from me will be charging me £800 each on them too. The stress this has caused me is unbearable. Anyone got any advice?

Unfortunately you won’t be able to tax the car unless it’s in trade. It’s a nightmare mate. Dvla take the Michael with the log books if your car isn’t in trade. If you ring them they’ll just say you should’ve not bought a car without the v5. That’s what they said to me anyway. I had to wait 4-5 weeks for the log book to come through and then sell the car.
